Rulemaking Activity

Rulemaking, as one of the areas of activity of government bodies, occupies a crucial place in the legal regulation system of any country in the world.

The rulemaking function in the Ministry of Justice is carried out by the Department for Legal Regulation of Constitutional Development, the Main Department for Rulemaking Activity in the Economy, the Department for Legal Regulation of Law Enforcement, the Department for Legal Regulation in Construction and Environmental Management, and the Department for Legal Regulation of State Social Activities.

The rulemaking functions of the Ministry of Justice are implemented through:

reviewing and coordinating draft laws of the Republic of Belarus, decrees, and orders of the President of the Republic of Belarus;

conducting mandatory legal review of draft resolutions of the Council of Ministers of the Republic of Belarus;

preparing draft regulatory legal acts and proposals for legislative improvement;

summarizing practices in the preparation of draft regulatory legal acts;

conducting audits of the state of rulemaking in national government bodies subordinate to the Government of the Republic of Belarus;

Participation in the processes of unification and harmonization of the legislation of the Republic of Belarus and the Russian Federation, the Eurasian Economic Union, and the member states of the Commonwealth of Independent States.

The Constitution of the Republic of Belarus of 1994 (as amended by the national referendums of November 24, 1996, October 17, 2004, and February 27, 2022);

Law of the Republic of Belarus of July 17, 2018 No. 130-Z "On Regulatory Legal Acts";

Decree of the President of the Republic of Belarus of April 16, 2026 No. 130 "On Rule-making";

Resolution of the Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 "On the Regulations of the Council of Ministers of the Republic of Belarus".
